The Loyalty Program is a free program offered by AUTOGRILL to reward touring coach drivers for
their loyalty (hereinafter referred to as “the Program”).
Drivers who
register automatically benefit free of charge from a “Groups Service France”
membership card allowing them to obtain a certain number of advantages set out below on all
AUTOGRILL establishments on the French motorway network ( mainland)
excluding :
On the FoodCourt Rivoli at the Carrousel du Louvre in Paris managed by AUTOGRILL, this
program is not valid. On a commercial basis, a free meal (worth €25 maximum) will be
granted to the driver, only in the event of a group menu reservation on the Carrousel
(he will not be entitled to a gift voucher or to accumulate points on his card).
This loyalty program is not valid for:

Membership by the tourist coach driver implies his unreserved acceptance of these general
conditions, who declares and acknowledges having perfect knowledge of them.

Supporting documents will be requested regardless of the membership method.
This card is free, nominative and strictly personal. It cannot be transferred and is in no way a
payment card. The loyalty card cannot be combined with other loyalty programs and cards in force
at AUTOGRILL, in particular with the “Trucker” loyalty card. The tourist coach
driver cannot have 2 active bus loyalty cards in his possession.
In the event of
renewal of the card (following loss, theft or deterioration of the old one), the member will not
benefit from any advantage in restaurants, while it takes time to renew a card.
As
the transfer of points to the new card is not automatic, the member must make a request to
Groups service.
Program benefits are valid until 12/31/2024.

opposite the “new points balance”.

the second driver of the same coach, with the exception of the advantages relating to obtaining
the gift voucher and the accumulation of points which do not apply to him.
THE DRIVER WILL ONLY BE ABLE TO BENEFIT FROM ALL THESE ADVANTAGES TWICE IN THE SAME DAY
AND ON TWO DIFFERENT STOPS WHICH MUST BE A MINIMUM OF 3 HOURS SEPARATED
Beyond these 2 passages, no more advantages will be granted to the Member.

If the bus driver does not have a loyalty card:
No advantage can be granted to
drivers if they are not in possession of their loyalty card on the day of passage except if they
are accompanied by a reserved group. In this specific case, he will benefit from a free meal.

Tickets Kadéos gift vouchers in the amount of €10 are accepted for payment in AUTOGRILL establishments (in stores & restaurants except in Mc Donald's, Mc Café and Burger King restaurants), throughout the French motorway network and in the FoodCourt Rivoli at the Carrousel du Louvre in Paris. They are also valid in many brands (to find out about them, go to the site www.kadeos.fr ).
These general conditions apply to the services defined above, concluded between touring coach
drivers and AUTOGRILL. It is specified that the “Groups Service France” brochure as
well as any other prospectus, advertising or catalog has only informative and non-contractual
value.
These general conditions are communicated to the member coach driver
(hereinafter “the Buyer”) upon simple request by email or post to the AUTOGRILL
address.
No special condition can, unless formal and written acceptance from
AUTOGRILL, prevail over these general conditions. The fact that AUTOGRILL does not avail itself
of these general conditions at any time cannot be interpreted as a waiver of the right to
subsequently avail itself of any of these conditions.
These general conditions of sale are expressly approved and accepted by the Buyer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory, previous document and in particular, his own general conditions of sale. 'purchase.
In the event of suspicion of fraudulent use of the card, or inappropriate behavior towards
AUTOGRILL personnel, AUTOGRILL reserves the right, at any time, and without notice, to remove
the driver holding the card from the loyalty program and cancel the benefits obtained on the
date of cancellation.
The frauds and behaviors retained (non-exhaustive list) are:
Threatening attitude, verbal or physical aggressiveness towards all AUTOGRILL staff, loan of the
loyalty card to any third party, abusive use of the loyalty card on the same stopping in order
to benefit from the same advantages several times, excessively exceeding the number of items
offered making up each promotional menu, direct resale to coach passengers of items offered by
AUTOGRILL using the points accumulated on the card.
AUTOGRILL also reserves the
right to take any action it deems useful in the event of inappropriate behavior by beneficiaries
of the Program or fraudulent or abusive use of the card (in particular, the withdrawal of
non-active cards during checkout). . Any breach of these general conditions, any falsification
of information transmitted to AUTOGRILL headquarters, will automatically result in the
cancellation of the card holder.
In the event of non-use of the card by a member over a period of 12 months, AUTOGRILL reserves the right to deactivate their loyalty card and consequently terminate the driver's membership in this loyalty program.
The Contract is considered concluded upon acceptance of these general conditions by the member.
At any time, the touring coach driver may cancel his registration by mail with acknowledgment of
receipt sent to AUTOGRILL at the address given below with one month's notice. Such
termination results in a complete withdrawal from the Program and, therefore, in the elimination
of the benefits associated with the latter.
AUTOGRILL reserves the right to cancel at any time, subject to informing the loyalty card holders
by any means deemed necessary, giving one month's notice, the loyalty program without the
coach driver tourism cannot claim any compensation.
The loss of the operating
authorization by AUTOGRILL for any reason whatsoever of an establishment leads to the automatic
cancellation of membership in the “bus” loyalty program for this establishment
without the driver being able to claim a refund. compensation for this.
The Card
remains the exclusive property of AUTOGRILL and can be returned to it at its request.
The liability of each Party will be released in the event that it becomes impossible for it to
perform part or all of its obligations due to the occurrence of events having the character of
force majeure and beyond the control of the debtor party, which could not be reasonably foreseen
when the contract was concluded and whose effects cannot be avoided by appropriate measures, as
usually retained by case law and defined within the meaning of article 1218 of the Civil Code.
The Party invoking an event constituting force majeure or fortuitous events must notify the
other Party by all means, following the occurrence or threat of this event and within a maximum
of five days. The execution of the obligations of the prevented Party will then be postponed for
a period equal to that of the duration of the suspension due to this cause.
The
Parties agree that they must consult as soon as possible in order to take all reasonably
possible measures with a view to continuing the execution of the contract.
However,
beyond a period of one month of interruption due to force majeure, each Party may choose to
terminate this contract automatically, by registered letter with acknowledgment of receipt sent
to the other Party, and this without compensation from either side.
AUTOGRILL declines all responsibility for the direct or indirect consequences of any anomaly or malfunction of the AUTOGRILL loyalty card, whatever their causes. AUTOGRILL will nevertheless make its best efforts to preserve for each member in the event of a malfunction or anomaly, the benefit of their accumulation of points or its advantages.
Any complaint from the Program member must be sent to AUTOGRILL Groups Services –
“BUS” loyalty program – 18, Rue Jacques Réattu – BP 81, 13275
MARSEILLE CEDEX 09.
The member indicates the subject of their complaint and attaches
any appropriate supporting documents directly related to their complaint.
These General Terms and Conditions are subject to French law. In the event of a dispute, the
dispute will be submitted to the courts of Marseille.
In the event of a dispute, the
Customer may first contact AUTOGRILL in order to seek an amicable solution.
In accordance with articles L.611 to L.616 and R.612 to R.616 of the Consumer Code, following the
transposition of European directive no. 2013/11/EU of May 21, 2013 relating to the extrajudicial
settlement of disputes consumption, the Buyer may have free recourse to a consumer mediator with
a view to resolving a dispute between him and AUTOGRILL.
The consumer must prove
having contacted the AUTOGRILL Marketing department in writing at the address referred to in
article 11.1 above to try to resolve their dispute and not having obtained a satisfactory
response within two months. He must contact the Mediator within a maximum of one year from his
written complaint to the AUTOGRILL Marketing department.
The Mediator is contacted
either via the internet (
https://www.mediationconso-ame.com ) by completing the form dedicated to this purpose made
available to him, or by post: AME CONSO, 197 Boulevard Saint-Germain, 75007 Paris.
The referral must include the Buyer's full contact details (surname, first name, postal
address, email and telephone number), a copy of the complaint sent to the marketing department
and the response received, a brief summary of the facts of the Buyer's request and all
supporting documents supporting his request (invoice, proof of payment, etc.).
The
outcome of the mediation will occur no later than 90 days from the referral to the mediator,
unless the latter decides to extend this period in the event of a complex dispute.
Finally, if the opinion rendered by the Mediator does not satisfy one or other of the Parties,
they are not obliged to accept it and may consider legal action in accordance with the
provisions of Article 19. hereof.
All advertising and/or technical documents provided to the Buyer remain the exclusive property of AUTOGRILL, the sole owner of the intellectual property rights. The Buyer undertakes not to make any use of these documents likely to infringe the intellectual property rights of AUTOGRILL.
AUTOGRILL COTE FRANCE, having its head office located at 18 rue Jacques Réattu, BP81,
13275 Marseille Cedex 09 (“Autogrill” or “Company” or “we”
or “us”), acting as data controller of personal data ( “Data
Controller”), informs you that your personal data is processed by electronic and
non-electronic means, in accordance with logic and procedures linked to the objectives set out
below and in compliance with the General Data Protection Regulation ( GDPR), including privacy
and security principles.
> Purposes of processing necessary for the management of
the Bus Driver Loyalty Program
AUTOGRILL collects the personal data you provide in
the course of its business activity, including details of orders placed online, and through your
interactions with AUTOGRILL.
AUTOGRILL processes your personal data for the purpose of
managing Bus Driver loyalty cards and providing you with the associated services, for
statistical processing and archiving purposes, and for commercial prospecting purposes. The
communication of data is necessary for the purposes indicated above and any refusal could
prevent you from benefiting from the Bus Driver Loyalty Program and associated services.
> Legal bases for processing
The legal bases for the processing of your data by
AUTOGRILL are as follows:
> Recipients of your personal data and communication to third parties.
In
accordance with the GDPR, personal data about you may be used periodically to update or correct
information previously collected.
Your personal data will be processed by
Autogrill's Marketing Department, as well as its Information Systems Department and its
Legal Department. Your personal data may be communicated to the Autogrill reservation center
(service provider) and to IT service providers responsible for the maintenance and hosting of
the website and information systems. Your personal data may also be transmitted to third parties
in the following cases: (i) when the communication is required by law and regulations applicable
to legitimate third parties, such as, for example, public authorities and bodies for
institutional purposes, authorities responsible for enforcing anti-money laundering laws, or
judicial authorities; (ii) in the event of extraordinary transactions (e.g. mergers,
acquisitions, sale of businesses, etc.).
Subcontractors acting in accordance with
the instructions of AUTOGRILL COTE France will be required to implement appropriate protective
measures. If certain Autogrill partners are located in countries whose regulations do not
necessarily offer the same level of protection as that of the member states of the European
Union, Autogrill will ensure that these transfers are carried out in accordance with the
provisions imposed by the French regulations (such as the implementation of contractual clauses
adopted by the European Commission). Upon simple request to the Data Protection Officer or his
French Relay, we can provide you with more information on these transfers.
Personal
data is intended for use by our duly authorized personnel (e.g. retail sales personnel). Your
personal data is also shared with service providers, for example for the purposes of carrying
out functional services of a technical and organizational nature for the purposes indicated
above. We only provide these third parties with the data necessary for the agreed provision of
services and these third parties act as data processors, based on the instructions received by
AUTOGRILL.
> Transfers of personal data outside the European Union
Some of the AUTOGRILL group companies which receive your personal data may be established
outside the European Union, in countries which do not guarantee an adequate level of protection
of personal data within the meaning of the GDPR. Autogrill takes the necessary precautions to
ensure that data transfer is carried out in accordance with French regulatory requirements (for
example by implementing standard contractual clauses approved by the European Commission). Upon
simple request made to our Data Protection Officer / Representative, we can provide you with
more information on these transfers and send you a copy of the relevant documents.
> Data retention
Your personal data is retained by AUTOGRILL for the period
necessary to achieve the purposes for which your personal data is collected and for the
fulfillment of legal and regulatory obligations.
If you have consented to the
processing of your personal data, data relating to orders placed are recorded for marketing
purposes for a period of 3 years in internal archives and 5 years in external archives, data
relating to commercial prospecting are kept for 3 years from the last commercial contact. At the
end of these periods, the data will be automatically deleted or made anonymous in a permanent
and irreversible manner.
Furthermore, the data will be erased or anonymized
permanently to achieve the aforementioned purposes, except in the case where AUTOGRILL is
required to retain the data for an additional period in order to comply with legal or regulatory
obligations.
